You have contacted us after viewing our website and have engaged us to assist in the preparation of a TRT (testosterone replacement therapy) protocol or related program.
The fees for the program, as advised at your initial consultation, are inclusive of GST and must be paid in full (including GST) prior to receiving any medications.
You agree to provide all information requested by us honestly and completely so that we may facilitate an appropriate program for you.
You acknowledge that we facilitate clinical consultation only, and that all clinical advice or treatment recommendations provided by any clinical or medical practitioner are given independently of us.
We will arrange the clinical consultation by telephone (or other agreed means), and you agree to provide the clinical or medical practitioner with all information requested.
You understand that the clinical or medical practitioner will determine whether you are suitable for a program.
If you are considered suitable for a program, you agree to undergo all reasonably necessary investigations, including blood tests, pathology and any other relevant testing for preparation of the program. We may choose not to proceed with providing a program to you even after pathology testing has been completed.
You agree that the clinical or medical practitioner may prescribe medications or supplements. Any such prescription is independent of us, and you agree to indemnify us against any claim or consequence you may suffer in connection with any medications or supplements prescribed by the clinical or medical practitioner.
You acknowledge that the program provided may not constitute strict medical or clinical advice in itself and that you have made your own enquiries regarding the advice or direction given by the clinical or medical practitioner.
You acknowledge and agree that you are not entitled to a refund of any monies paid merely because you are dissatisfied with:
the program;
any prescribed medication or supplement;
a change of mind; or
any other reason.
You agree that from time to time we will obtain your medical and other personal information. We agree to hold such information in strict confidence and not disclose it to any third party (other than the clinical or medical practitioner) without your prior written consent, unless required by law.
You may request copies of your medical information, which we agree to provide upon payment of a reasonable fee to reproduce that information.
We shall not be liable to you, whether in contract, tort or otherwise, for any cause or claim (including negligence) for any injury, damage or loss, including special, indirect or consequential loss or damage to persons or property, arising out of the program or any medications or supplements, including any defect in those medications or supplements, or any defect in the advice provided by the clinical or medical practitioner.
You agree that the provisions of the Civil Liability Act 2002 (or any equivalent legislation) which provide for a proportionate liability regime are expressly excluded in relation to the rights, obligations and liabilities of the parties under these terms.
We are not responsible in any way for any false, incomplete or misleading information that you provide.
These Terms and Conditions are governed by the laws in force in New South Wales, and you irrevocably submit to the exclusive jurisdiction of the courts of New South Wales.
“us”, “we” means I Got My Life Back Pty Ltd.
“you”, “your” means you, the user or patient.
“clinical or medical practitioner” means any practicing healthcare provider, clinician or medical practitioner that we arrange or engage on your behalf.
“fee” means any fees for the program as previously quoted to you.
“program” means any recommendations, plans, TRT protocol or other advice we consider relevant to your circumstances.
